Tactics in Interrogation of Juvenile Offenders: Peculiarities of Legal Regulation

Abstract

The study aims to determine the theoretical and legal basis for the tactics of interrogation of minors in Kazakhstan, to identify promising areas for improving the legal regulation of interrogation of this category of participants in criminal proceedings in the Republic of Kazakhstan. A comprehensive methodology was employed to analyse the regulatory framework, incorporating systematic, formal legal, and formal logical methods. The study addressed the state of regulatory and legal support for the interrogation of juvenile offenders in Kazakhstan. The study emphasized the need to enshrine the possibility of restricting the participation of a legal representative in criminal proceedings or replacing it completely with another legal representative in cases where participation may harm a minor or adversely affect the course of criminal proceedings. The study formulated recommendations that can be used to improve the legal regulation of interrogation of minors in the Republic of Kazakhstan.

El estudio tiene como objetivo determinar la base teórica y legal de las tácticas de interrogatorio de menores en Kazajistán, así como identificar áreas prometedoras para mejorar la regulación legal del interrogatorio de esta categoría de participantes en procesos penales en la República de Kazajistán. Se empleó una metodología integral para abordar el marco regulatorio, el proceso real y se aplicaron métodos legales y lógicos formales. El estudio analizó el estado del apoyo regulatorio y legal para el interrogatorio de infractores juveniles en Kazajistán. El estudio enfatizó la necesidad de establecer la posibilidad de restringir la participación de un representante legal en los procesos penales o de reemplazarlo por completo con otro representante legal en casos en que su participación pueda perjudicar a un menor o afectar negativamente el curso del proceso penal. El estudio formuló recomendaciones que pueden utilizarse para mejorar la regulación legal del interrogatorio de menores en la República de Kazajistán.

Cette étude vise à déterminer les fondements théoriques et juridiques des tactiques d’interrogatoire des mineurs au Kazakhstan et à identifier les pistes prometteuses pour améliorer la réglementation des interrogatoires de cette catégorie de participants aux procédures pénales en République du Kazakhstan. Une méthodologie complète a été utilisée pour analyser le cadre réglementaire, le processus lui-même et appliquer des méthodes juridiques et logiques formelles. L’étude a examiné l’état du soutien réglementaire et juridique aux interrogatoires des mineurs délinquants au Kazakhstan. Elle a souligné la nécessité de prévoir la possibilité de restreindre la participation d’un représentant légal aux procédures pénales ou de le remplacer complètement par un autre représentant légal lorsque cette participation risque de porter préjudice à un mineur ou d’avoir un impact négatif sur le déroulement de la procédure. L’étude a formulé des recommandations pour améliorer la réglementation des interrogatoires des mineurs en République du Kazakhstan.

本研究旨在探讨哈萨克斯坦未成年人讯问策略的理论和法律基础,并找出有潜力改进哈萨克斯坦共和国刑事诉讼中此类参与者讯问法律规制的领域。本研究采用综合方法,探讨规制框架和实际流程,并运用正式的法律和形式逻辑方法。本研究探讨了哈萨克斯坦对未成年人罪犯讯问的监管和法律支持现状。研究强调,有必要在法定代理人参与刑事诉讼程序可能对未成年人造成伤害或对刑事诉讼进程产生不利影响的情况下,限制法定代理人参与诉讼程序或完全由其他法定代理人替代。本研究提出了一些建议,可用于改进哈萨克斯坦共和国对未成年人讯问的法律规制。

تهدف الدراسة إلى تحديد الأساس النظري والقانوني لأساليب استجواب الأحداث في كازاخستان، وتحديد المجالات الواعدة لتحسين التنظيم القانوني لاستجواب هذه الفئة من المشاركين في الإجراءات الجنائية في جمهورية كازاخستان. استُخدمت منهجية شاملة لمعالجة الإطار التنظيمي، والعملية الفعلية، والأساليب القانونية الرسمية والمنطقية الشكلية. تناولت الدراسة حالة الدعم التنظيمي والقانوني لاستجواب الأحداث الجانحين في كازاخستان. وأكدت الدراسة على ضرورة ترسيخ إمكانية تقييد مشاركة الممثل القانوني في الإجراءات الجنائية أو استبداله كليًا بممثل قانوني آخر في الحالات التي قد تُلحق فيها المشاركة ضررًا بالقاصر أو تؤثر سلبًا على سير الإجراءات الجنائية. صاغت الدراسة توصيات يمكن استخدامها لتحسين التنظيم القانوني لاستجواب الأحداث في جمهورية كازاخستان.
