Providing Administrative Courts with Protection from Violation of the Rights to Social Protection and Pension Provision for Internally Displaced Persons in Ukraine

Abstract

The study aims to investigate Ukrainian residents’ access to justice in cases where internally displaced people are compelled to file an appeal with the court against decisions made by State authorities that infringe on their rights to social security and pension support. The study makes use of classification and analogy techniques. Analysis and synthesis were the primary research methodologies. The formal legal method – specifically, the procedures of deduction and systematization – is one of the unique legal techniques employed. The definition of the term “internally displaced person” in the context of international law is the study’s output. It was done to become familiar with the key international agreements that define the legal status of internally displaced people. Using instances from other nations, the issue of internally displaced people within a nation was identified. This occurs during times of war or other situations that endanger the safety of individuals at their place of residence. It emphasizes integrating international best practices to safeguard these people’s rights inside national legal systems, particularly regarding social and pension provisions. It is determined that administrative procedures must be improved.

El estudio busca investigar el acceso de los residentes ucranianos a la justicia en casos en que las personas desplazadas internas se ven obligadas a apelar ante los tribunales contra decisiones de las autoridades estatales que vulneran sus derechos a la seguridad social y a las pensiones. El estudio utiliza técnicas de clasificación y analogía. El análisis y la síntesis fueron las principales metodologías de investigación. El método jurídico formal – específicamente, los procedimientos de deducción y sistematización – es una de las técnicas jurídicas singulares empleadas. La definición del término “persona desplazada internamente” en el contexto del derecho internacional es el resultado del estudio. Este se realizó para familiarizarse con los principales acuerdos internacionales que definen la condición jurídica de las personas desplazadas internamente. Utilizando ejemplos de otros países, se identificó la problemática de las personas desplazadas internamente dentro de un país. Esto ocurre en tiempos de guerra u otras situaciones que ponen en peligro la seguridad de las personas en su lugar de residencia. Se hace hincapié en la integración de las mejores prácticas internacionales para salvaguardar los derechos de estas personas en los sistemas jurídicos nacionales, en particular en lo que respecta a las prestaciones sociales y de pensiones. Se determina la necesidad de mejorar los procedimientos administrativos.

L’étude vise à examiner l’accès à la justice des résidents ukrainiens lorsque des personnes déplacées à l’intérieur du pays sont contraintes de déposer un recours devant les tribunaux contre des décisions des autorités publiques portant atteinte à leurs droits à la sécurité sociale et à la pension. L’étude utilise des techniques de classification et d’analogie. L’analyse et la synthèse ont été les principales méthodologies de recherche. La méthode juridique formelle, plus précisément les procédures de déduction et de systématisation, est l’une des techniques juridiques uniques employées. La définition du terme « personne déplacée à l’intérieur du pays » dans le contexte du droit international est le résultat de l’étude. Elle a été réalisée afin de se familiariser avec les principaux accords internationaux qui définissent le statut juridique des personnes déplacées à l’intérieur du pays. À l’aide d’exemples étrangers, la problématique des personnes déplacées à l’intérieur du pays a été identifiée. Ce phénomène survient en temps de guerre ou dans d’autres situations mettant en danger la sécurité des personnes sur leur lieu de résidence. L’accent est mis sur l’intégration des meilleures pratiques internationales pour garantir les droits de ces personnes dans les systèmes juridiques nationaux, notamment en matière de prestations sociales et de pension. Il est déterminé que les procédures administratives doivent être améliorées.

本研究旨在调查乌克兰居民在境内流离失所者被迫就国家当局侵犯其社会保障和养老金权利的决定向法院提起上诉时获得司法救助的情况。本研究运用了分类和类比技术。分析和综合是主要的研究方法。正式的法律方法——具体而言,即演绎和系统化程序——是所采用的独特法律技术之一。本研究的成果是在国际法背景下对“境内流离失所者”一词的定义。本研究旨在熟悉界定境内流离失所者法律地位的主要国际协定。通过其他国家的案例,本研究确定了一个国家境内流离失所者的问题。这种情况发生在战争时期或其他危及居住地个人安全的情况下。本研究强调整合国际最佳实践,在国家法律体系中保障这些人的权利,特别是在社会和养老金方面。本研究确定必须改进行政程序。

تهدف الدراسة إلى دراسة مدى وصول سكان أوكرانيا إلى العدالة في الحالات التي يُجبر فيها النازحون داخليًا على تقديم استئناف أمام المحكمة ضد قرارات صادرة عن سلطات الدولة تنتهك حقوقهم في الضمان الاجتماعي ودعم المعاشات التقاعدية. تعتمد الدراسة على تقنيات التصنيف والقياس، بينما شكّل التحليل والتوليف منهجيتي البحث الأساسيتين. يُعدّ المنهج القانوني الرسمي - وتحديدًا إجراءات الاستنباط والتنظيم - أحد الأساليب القانونية الفريدة المستخدمة. ويُعد تعريف مصطلح “النازح داخليًا” في سياق القانون الدولي نتاجًا للدراسة. وقد أُجريت هذه الدراسة للتعرف على الاتفاقيات الدولية الرئيسية التي تُعرّف الوضع القانوني للنازحين داخليًا. وبالاستفادة من تجارب من دول أخرى، تم تحديد مشكلة النازحين داخليًا داخل الدولة. ويحدث هذا في أوقات الحرب أو غيرها من الحالات التي تُهدد سلامة الأفراد في أماكن إقامتهم. وتُشدد الدراسة على دمج أفضل الممارسات الدولية لحماية حقوق هؤلاء الأشخاص في النظم القانونية الوطنية، لا سيما فيما يتعلق بالأحكام الاجتماعية والمعاشات التقاعدية. وتؤكد الدراسة على ضرورة تحسين الإجراءات الإدارية.
